Terms of Service

1. The service
Elder Protect provides AI-assisted call screening: an automated assistant answers calls to a designated phone line, checks callers against spam databases and your trusted-contact list, converses with unknown callers, and forwards, takes a message from, or declines calls based on that screening. The service also provides a caregiver dashboard, call transcripts, and notifications.
2. Not an emergency service
Elder Protect is not a substitute for emergency services and must not be relied upon to reach or screen emergency communications. Always dial 911 (or your local emergency number) in an emergency. We do not guarantee that any particular call will be connected, forwarded, or blocked.
3. Accounts and eligibility
You must be 18 or older to create an account. You are responsible for your login credentials and for the accuracy of the information you provide, including the phone number the service screens. You may only configure screening for a phone line you own or for a person who has authorized you to manage their calls.
4. Call recording, transcription, and consent
The service answers, transcribes, and may record calls on the screened line. Laws on recording and monitoring calls vary by jurisdiction, and some require the consent of all parties. You are responsible for ensuring that your use of the service — including transcription and any recording — complies with the laws that apply to you and to your callers, and for obtaining any required consents (including from the person whose line is screened).
5. Subscriptions, trials, and billing
Paid plans are billed monthly through our payment processor, Stripe. New subscriptions begin with a 14-day free trial; when the trial ends your payment method is charged unless you cancel first. You can change or cancel your plan at any time from Settings → Billing; cancellation takes effect at the end of the current billing period. Fees are non-refundable except where required by law. We may change pricing with at least 30 days' notice.
6. Acceptable use
You agree not to use the service to violate any law, to screen a line without authorization, to harass callers, to probe or disrupt the service, or to attempt to access other customers' data. We may suspend or terminate accounts that violate these terms.
7. Third-party services
The service depends on third-party providers — including telephony carriers, payment processing, and AI model providers. Their availability affects ours, and calls routed through the service pass through those providers subject to their terms.
8. Disclaimers
The service is provided “as is” and “as available.” Screening decisions are automated and probabilistic: some unwanted calls may get through and some legitimate calls may be screened, delayed, or missed. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose.
9. Limitation of liability
To the maximum extent permitted by law, our total liability for any claims arising out of or relating to the service is limited to the amounts you paid us in the twelve months before the claim arose. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for losses resulting from calls that were or were not connected.
10. Termination
You may close your account at any time. We may suspend or terminate the service for breach of these terms, non-payment, or discontinuation of the product, with reasonable notice where practicable. Upon termination we will delete your data in accordance with our Privacy Policy.
11. Changes to these terms
We may update these terms from time to time. If a change is material we will notify you by email or in the dashboard at least 14 days before it takes effect. Continued use after the effective date constitutes acceptance.
